Worldwide, the death penalty is still utilized as a means of limiting the freedom of expression, of assembly, and of association of lesbian, gay, bisexual, transgender, queer, and other sexual and gender minorities (LGBTQ+) based on actual or perceived sexual orientation. Criminalization of status, such as sexual orientation or identity, creates a context where LGBTQ+ communities are restricted from civic engagement in ways that would protect against the violation of their human rights. The death penalty and sexual orientation intersect in numerous ways with severe, permanent harm to diverse communities such as human rights defenders and LGBTQ+ individuals, infringe upon core rights including freedom of expression, association, and assembly, the rights to privacy and dignity, along with the bundle of associated fair trial rights, the right to be free from torture, and the rights to equal protection of the law.
