United States of America / General - Committee on the Elimination of Discrimination against Women - Death Penalty - February 2025

This submission aims to demonstrate how gender stereotypes influence the trials of women accused of capital crimes, leading to violations of their fundamental rights under the CEDAW Convention1 . It’s primarily based on Sandra Babcock’s forthcoming essay, Gendered Capital Punishment2 , which explores these issues in depth. Her article draws from the trial transcripts of the forty-five cisgender women on death row in the United States as of July 1, 2024. In addition to Sandra Babcock’s essay, this submission draws on reports from the Cornell Center on the Death Penalty Worldwide (CCDPW) which were built on the basis of information shared by abolitionist organizations based in countries that retain the death penalty.
